disclosure,

on the 23, 24, of august brendan dixon will go to the high court in edinburgh. where his legal team will ask again for the release of vital statements.

what have the crown got to hide!,
it does not only happen in the case of the killie 2, but more and more cases in scotland eg william gage, and william beck to name a few.

will the disclosure be released, i hope so, for our justice system to work we need an open system going from police to pf, to crown. and no hold up's, my brother-inlaw has already spent 2, and a half years in prison for a crime he did not do, while the real killer walks free.

The case to be referred to is Holland and Sinclair and made by Privy Council. See following:

THE head of Scotland's biggest association of court lawyers has claimed that a "significant number" of cases are collapsing because of a failure by prosecutors to show the defence key evidence on time.
Gerry Considine, the president of the Glasgow Bar Association, says delays by the Crown Office in disclosing potentially crucial evidence, including DNA reports and witness statements, have caused "terminal delays" to cases.

Two years ago, the judicial committee of the Privy Council, the highest criminal appeal court, quashed the convictions of two Scots, James Holland and Alvin Sinclair, on the grounds the Crown had failed to disclose vital documents and therefore denied their right to a fair trial.
Until then, the disclosure of Crown evidence or information had rested with the Lord Advocate and Crown Office.
But the landmark rulings decreed that, unless there are national security implications, all statements have to be made available to the defence "as a matter of course".
The Crown is also now required to give the defence details of previous convictions and outstanding charges in relation to prosecution witnesses.

My very best wishes to Brendan Dixon and all his supporters on the 23/24 August.

I’m sure the Scottish Crown Office, under the ever watchful eyes of Messrs Alex Salmond MSP/MP (Scotland’s First Minister) and Kenny MacAskill MSP (Scotland’s Cabinet Secretary for Justice … note the words FOR JUSTICE), will ensure there is now FULL CROWN OFFICE DISCLOSURE in this case, so that this most appalling miscarriage of Scottish “Justice” can rectified as soon as possible.

Kevin deserves the highest praise for his unstinting fight for his brother-in-law, and his passion about the many injustices currently happening in Scotland and UK-wide knows no bounds.

My thoughts will be with you all on 23/24 August.

All good wishes,

Al

How right you are, Kevin.

That's why i'll keep fighting for Guje and her family until, as i said on the McKie Forum, my "good friends" (tongue firmly in cheek!) Messrs Salmond and MacAskill finally relent to a wholly independent, thorough and full investigation into Annie's case ... with no stones left unturned.

Again, i wish Brendan and you all well on 23/24 August - and will keep an eye on the forums and media over these days.

All the very best to you as always,

Al

No worries Kevin.

Even if you just show people some moral support and let them know you are thinking of them and are concerned for their plight (especially when they've been fitted up at the murky hands of our, very often, corrupt Scottish "Justice" system), that can always be a little help.

As can continually chipping away at the powers that be, as we have been doing in Annie's case and others. I feel that the ever-defiant intransigence exhibited by the all-too-powerful, arrogant and wholly unaccountable Scottish Crown Office (under Elish Angiolini’s rule) and by our obdurate SNP-ruling Scottish Executive (under Messrs Salmond and MacAskill … equal in deviance and indifference to that of their Lord Advocate I find) will eventually be overcome, and they will finally yield to the pressure … so long as they know we are not going to go away and will continue to fight against their self-protective, unjust and criminal behaviour (ain’t that right Messrs Salmond and MacAskill?! … two more despicable human beings you really could not come across, in my personal experience of them both).

All good wishes,

Al

PS. Don't worry Kevin. Messrs Salmond and MacAskill won't sue me ... i know too many things.
